Let's just say that somebody wants to buy the uncut episodes from the Patrick Troughton era as they appeared on tv in the 60s. The buyer hands over the money and finds recons instead of the actual episodes. There is nothing in the advertisement saying that you are getting recons instead of the actual episodes. The advertising is misleading and false in an attempt to get people to hand over their hard earned money. A judge or a jury with any common sense would find that this would be a case of fraud when presented the facts.

Well, considering selling recons is illegal - in fact, selling unofficial downloaded rips of official BBC products is completely illegal to start with, which is clearly what this is - I think that you wouldn't actually have to buy the dvds to get these people into trouble.
